It’s a question we have been asked over the past year from clients and candidates…can we ask the interviewer or the interviewee if they have been vaccinated vaccinated? The short answer is, yes, but it’s a slippery slope.
The Americans with Disabilities Act prohibits employers from asking applicants questions that would reveal a disability before making a job offer, however the EEOC clarified that whether or not an individual has received a covid vaccination is not a disability related inquiry under the ADA. Employers are also allowed to require employees to be vaccinated- but of course, there is a caveat.
